Nursery® Water Pure Fun Zone® Online Sweepstakes

NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT INCREASE YOUR ODDS OF WINNING.

1. How to Enter:The Nursery® Water Pure Fun Zone Online Sweepstakes (the "Sweepstakes") begins at 12:01 AM EST January 1, 2012 and ends at 11:59 PM EST on December 31, 2012 (the “Sweepstakes Period”).  To enter the Sweepstakes, enter on the web at www.nurserywater.com during the Sweepstakes Period. Limit of one entry per person per day per email address. Sweepstakes entries generated by a script, macro or other mechanical or automated means will be disqualified. All non-conforming entries are null and void and will be rejected. No mechanically reproduced entries are permitted. DS Waters of America, Inc. ("Sponsor") is not responsible for printing errors, late, lost, damaged, misdirected, incorrectly addressed, incomplete, stolen, illegible or postage-due mail and will not verify receipt of entries. All entries submitted become the sole property of Sponsor and will not be returned. Proof of sending will not be deemed proof of receipt. All entries must be received by Sponsor by 11:59 PM EST on December 31, 2012. All entries received thereafter will be deemed void. No letters, correspondence or contact other than the forms of entry listed above will be considered to be properly submitted entries. Sponsor reserves the right in its sole discretion to modify, suspend or terminate the Sweepstakes or any portion thereof and/or terminate the participation of any participant (and void his/her entry) whose conduct potentially compromises the Sweepstakes, and at their discretion to select the winner(s) in a random drawing from all eligible, non-suspect entries received for the drawing at issue prior to the event requiring such termination.
2. Eligibility: To enter the Sweepstakes, you must be 18 years of age or older and a parent or legal guardian of children eighteen (18) months to six (6) years of age at the time of entry, a legal resident of the United States, excluding Puerto Rico, Guam, U.S. Virgin Islands, and all other U.S. and foreign territories and possessions. Entrants must acknowledge that they are the parents or legal guardians prior to entry into the Sweepstakes.  Officers, employees and agents of Sponsor, their advertising and promotion agencies, their respective parent companies, affiliates, subsidiaries, and agencies and their immediate families and members of their households are ineligible to participate in the Sweepstakes. The Sweepstakes is void where prohibited by law.
3. The Sweepstakes Prizes: Prize winners will be randomly selected weekly from all eligible entries received during the Sweepstakes Period. If an entrant is not selected as a winner for a particular week, that entrant’s entry will be carried over into subsequent weekly prize drawings.  Each weekly prize winner will receive one (1) toy prize selected by Sponsor (Approximate Retail Value: $6.00-$29.95).  Any difference between stated ARV and actual value will not be awarded. Prizes are not designed for use by children under the age of eighteen (18) months of age.  Please allow 10 to 12 weeks for delivery of the prize.  All eligible entrants have a chance to win sweepstakes prizes. A weekly random drawing will occur to award the Sweepstake prizes beginning January 5, 2012. No transfer, substitution, or cash equivalent for prizes except in Sponsor's sole discretion due to prize unavailability, and then only for a prize of equal or greater value. All details of the prizes shall be determined in Sponsor's sole discretion. Any expenses, including taxes or registration associated with any prize are the sole responsibility of the winner. Adherence to any expiration dates on the prize or certificates is the sole responsibility of the winner.
4. Odds of Winning: Odds of winning any prize depend on the number of eligible entries received.
5. Prize Conditions: The Sweepstakes prize winners will be notified by phone or mail. The return of any prize notification as undeliverable may result in disqualification and an alternate winner will be selected. Nurserywater.com Pure Fun Zone Online Sweepstakes prize winners will be required to execute an affidavit of eligibility, a liability release and a publicity release (collectively, an "Affidavit/Release"). All Affidavit/Releases must be returned to Sponsor within the time indicated on the documents. If such documents are not returned within that time, or if a winner is found to be ineligible, or if winner does not comply with these Official Rules, then the winner will be disqualified and will not receive any prize. A winner's entry and acceptance of the prize constitutes permission for Sponsor to use said winner, winner's companions' and entrants’ names, photographs, likenesses, statements, biographical information, voices, and addresses (city and state) on a worldwide basis and in all forms of media, in perpetuity, without further authorization or compensation (except where prohibited by law). Prizes are not transferable and may not be exchanged for other prizes or for cash. Winners are solely responsible for the payment of all expenses and taxes associated with the winning the prize. If by reason of error, more prizes are claimed than the number set forth in these rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes. No more than the advertised number of prizes will be awarded.
6. Sweepstakes Conditions: The Sweepstakes is subject to all applicable federal, state and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor and waive any right to claim ambiguity in the Sweepstakes, or these Official Rules. If any provision of these Official Rules is declared to violate any federal, state or local law, it will be amended to conform to such law and all other provisions will remain in full force and effect. Winners and entrants also agree to release, discharge, indemnify and hold harmless Sponsor, its parent and affiliated companies and all of its officers, employees and agents from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes. Sponsor reserves the right to any video, audio, photographic or print material involving the winner(s) for promotional use without further permission or compensation. Any person attempting to defraud or in any way tamper with the Sweepstakes will be ineligible for prizes and may be prosecuted to the full extent of the law. If, after the contest has begun, changes or updates to the rules are made, the changes will be posted with the official contest rules at www.nurserywater.com. The decisions of Sponsor with regard to the awarding of the prizes and the interpretation of these rules shall be final. Sponsor reserves the right to end the Sweepstakes earlier than the date listed or to extend the length of the Sweepstakes.  Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or is otherwise in violation of the rules, and further reserve the right to cancel, terminate or modify the contest if it is determined that it is not capable of completion as planned due to tampering, technical failures or any other cause.
7. LIABILITY LIMITATIONS: Neither Sponsor nor its parent, affiliates, subsidiaries, advertising and promotion agencies (including all of their respective officers, directors, employees, representatives, and agents)  are responsible for invalid entries or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), web site, telephone, or other connections, availability, or accessibility, or miscommunications, or failed computer, satellite, telephone, or cable transmissions, or lines, or technical failure or jumbled, garbled, corrupted, scrambled, delayed, or misdirected transmissions, or computer hardware or software or telephone malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic, or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information.  Neither Sponsor nor its parent, affiliates, subsidiaries, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives, and agents  are responsible for any incorrect or inaccurate information, whether caused by web site users, or by any equipment or programming associated with or utilized in this Sweepstakes and assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission, communications line failure, theft, or destruction, or unauthorized access to, or tampering with or hacking of Sponsor’s web site.  Sponsor is not responsible for injury or damage to participants’ or any other person’s computer related to or resulting from participating in this Sweepstakes or downloading or copying materials from or use of the web site.
   
   IN NO EVENT WILL SPONSOR, ITS PARENT, AFFILIATES, SUBSIDIARIES, AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF ACCESS TO AND USE OF THE SWEEPSTAKES, INTERNET WEB SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID WEBSITE.  WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS WEB SITE IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.  SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.  CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
8. Winners List: To receive a list of the Nurserywater.com Pure Fun Zone Online Sweepstakes prize winners or an additional copy of these Official Rules, send a self-addressed, stamped envelope to: Nurserywater.com Pure Fun Zone Online Sweepstakes, P.O. Box 4550, Marietta, Georgia 30061-4550, no later than April 30, 2012. Please specify "Rules" or "Winners List."
9. Official Rules: By participating in the Sweepstakes, entrants agree to be bound by these Official Rules and the decisions or interpretation of Sponsor regarding the Official Rules. Any decision or interpretation of Sponsor is final and not subject to appeal. Entrants waive any right to claim ambiguity in these Official Rules. Acknowledging that the Sweepstakes will be administered in the State of Georgia, all entrants agree that the laws of the State of Georgia, will govern this Sweepstakes and that any claim, issue or dispute, arising with respect to the Sweepstakes will be conclusively resolved without right of appeal by binding arbitration conducted in Georgia according to the commercial arbitration rules of the American Arbitration Association. Before commencing arbitration, the parties will use good faith efforts to negotiate a business resolution for no less than thirty (30) days after the claim, issue or dispute arises.
